1. INTRODUCTION AND AGREEMENT

These Terms and Conditions (“Legal Terms”) govern participation in the Lintons Loyalty Programme (“the Programme”), operated by Lintons Place Limited (“Lintons”, “we”, “us”, or “our”).

The Programme is designed to reward registered customers with loyalty points, discounts, offers, and other benefits as may be introduced from time to time for qualifying purchases made at Lintons’ participating outlets and platforms.

By enrolling in and using the Programme, you (“Member”, “you”, or “your”) confirm that you have read, understood, and agreed to be bound by these Legal Terms.

If you do not agree, you must not register for or participate in the Programme.

2. GENERAL CONDITIONS

2.1. Membership is open to individuals aged 18 years and above who are resident in Kenya.

2.2. Lintons reserves the right, at its sole discretion, to accept, decline, suspend, or terminate any membership application.

2.3. Membership is personal, non-transferable, and may only be used by the registered Member.

2.4. Members shall generally earn loyalty points on equal terms, save where special promotions or campaigns apply.

2.5. Participation requires registration using an active mobile number and acceptance of these Legal Terms.

2.6. Lintons may assign or transfer its rights and obligations under these Legal Terms to a third party, including system providers or programme partners, without affecting Members’ accrued rights.

2.7. Any abuse, misuse, or breach of these Legal Terms may result in suspension or termination of membership and forfeiture of accrued points.

2.8. Lintons reserves the right to amend, suspend, or discontinue the Programme or these Legal Terms, upon reasonable notice to Members, except where immediate changes are required for legal, regulatory, or security reasons.

2.9. These Legal Terms shall prevail over any promotional or marketing materials relating to the Programme.

 

3. ENROLMENT AND ACCOUNT MANAGEMENT

3.1. Customers may enroll in the Programme through designated digital platforms, including Odoo-enabled systems, mobile applications, or other channels as communicated by Lintons.

3.2. Members must provide accurate and complete registration information.

3.3. Log in credentials and verification details must be kept confidential. Members are responsible for all activity conducted through their accounts.

3.4. Lintons shall not be liable for losses arising from unauthorized account access where the Member failed to safeguard their credentials.

3.5. Members may update their personal details through approved customer service channels.

4. EARNING LOYALTY POINTS

4.1. Members may earn loyalty points for qualifying purchases of eligible Lintons products or services (“Qualifying Purchases”).

4.2. The earn rate, welcome bonuses, promotional multipliers, and eligible products shall be determined by Lintons and communicated from time to time.

4.3. Loyalty points:

  • Have no cash value;

  • Are not redeemable for cash;

  • May not be sold or exchanged outside the Programme.

4.4. Points balances may be viewed through Programme platforms integrated with Odoo or other authorized systems.

4.5. Lintons shall not be responsible for loss of points resulting from account deletion, mobile number deactivation, or system limitations beyond its reasonable control.

5. VALIDITY AND EXPIRY OF POINTS

5.1. Loyalty points may expire in the following circumstances:

  • Inactivity for a defined period communicated to Members;

  • where a Member’s account remains inactive for a continuous period of Six (6) months;

  • Failure to redeem points within the validity period;

  • Voluntary termination of membership;

  • Proven fraud or misuse;

  • Closure of the Programme following notice by Lintons.

5.2. Members shall receive reasonable notice prior to points expiry where practicable.

5.3. Expired points shall automatically lapse and cannot be reinstated.

6. REWARDS AND REDEMPTION

6.1. Redemption is available only to fully registered Members in good standing.

6.2. Rewards may include discounts, products, services, partner offers, or other benefits determined by Lintons.

6.3. Redemption values and reward availability may vary and are subject to change.

6.4. Third-party rewards are provided by partners, and Lintons does not guarantee their availability, quality, or performance.

6.5. Lintons shall not be liable for technical interruptions that may temporarily affect redemption.

7. DATA PROTECTION AND PRIVACY

7.1. Lintons is committed to protecting Members’ personal data in accordance with the Data Protection Act, 2019 (Kenya).

7.2. Personal data is collected and processed solely for Programme administration, customer engagement, analytics, and compliance purposes.

7.3. Data may be processed on systems hosted locally or outside Kenya, subject to appropriate safeguards and lawful data transfer mechanisms.

7.4. Members have the right to access, correct, object to processing, or request deletion of their personal data, subject to legal limitations.

7.5. Lintons’ Privacy Notice forms part of these Legal Terms.

8. TERMINATION OF MEMBERSHIP

8.1. Members may terminate their membership at any time through designated channels.

8.2. Upon termination, all unredeemed points shall expire.

8.3. Lintons may suspend or terminate membership where there is reasonable suspicion of:

  • Fraud or attempted fraud;

  • Breach of these Legal Terms;

  • Abuse of the Programme;

  • Misrepresentation or misconduct.

8.4. Lintons reserves the right to pursue legal remedies where necessary.

9. LIMITATION OF LIABILITY

9.1. To the maximum extent permitted by law, Lintons excludes all implied warranties relating to the Programme.

9.2. Lintons shall not be liable for indirect, incidental, or consequential losses arising from participation in the Programme.

9.3. Nothing in these Legal Terms limits liability for fraud, gross negligence, or matters that cannot be excluded by law.

10. ELECTRONIC COMMUNICATIONS

10.1. Members consent to receive Programme-related communications electronically, including SMS, app notifications, and emails.

10.2. Marketing communications shall be subject to Member consent and opt-out rights.

11. INTELLECTUAL PROPERTY

11.1. All intellectual property associated with the Programme remains the property of Lintons or its licensors.

11.2. Membership does not grant any licence to use Lintons’ trademarks or content.

12. THIRD-PARTY SERVICES

12.1. The Programme may integrate third-party platforms or services. Use of such services is at the Member’s own risk and subject to third-party terms.

13. SEVERABILITY

If any provision of these Legal Terms is found unenforceable, the remaining provisions shall remain valid.

14. GOVERNING LAW AND JURISDICTION

These Legal Terms shall be governed by and construed in accordance with the laws of Kenya, and the courts of Kenya shall have exclusive jurisdiction.
